PETITION FOR FUNDING FOR SOUNDWALL FOR IVANHOE DEVELOPMENTS

            COMES NOW, the undersigned PETITIONERS, and hereby set forth the need for expedited funding for sound walls along Interstate 75 in the below described Southwest Broward location known as “IVANHOE DEVELOPMENTS”;

            WHEREAS, there are residential homes located along side of Interstate 75, known as “Hawkes Bluff”, located on the west side of Interstate 75, between Griffin Rd and Stirling Rd.; “Waverly Hundred”, located on the west side of Interstate 75, between Stirling Rd. and just North of Sheridan Street; “Chelsea Homes” and “Waterford” , located on the East side of Interstate 75,located between Griffin Rd. and Stirling Rd, “Crossbow”, “Falcon’s Lea” and “Sheridan Glen”, located on the East side of Interstate 75 between Stirling Rd. and Sheridan Street, all collectively referred to herein as the “IVANHOE DEVELOPMENTS”, all located in the suburbs of western Broward County, Florida ;

            WHEREAS, the traffic flow of Interstate 75 has materially increased from the year 2000 to an unforeseeable level which is materially affecting the use and wellbeing of the residents residing in the IVANHOE DEVELOPMENTS, as follows:  The noise level (from trucks, motorcycles, ambulances) is preventing the residents from utilizing their yards, the noise level is affecting the tranquility, physical and mental health of its residents; The increased pollution is affecting the health and wellbeing of its residents; The noise level and pollution are affecting the property values of its residents and/or making the homes unmarketable and therefore causing a financial hardship for the families living therein;

            WHEREAS, the residents of the IVANHOE DEVELOPMENTS, are paying substantial sums in real estate taxes ranging between $5,000.00 and $12,000.00 and cannot have quiet enjoyment of their properties as a result of the unforeseen material increase in the traffic along side Interstate 75;

            WHEREAS, the Florida Department of Transportation has expressly advised the IVANHOE DEVELOPMENTS that a sound wall will not be built for approximately ten years, in that it will take approximately three years from today to complete a PD&E study, to determine the necessity of a sound wall, before funding for the sound wall can be determined and thereafter construction of the sound wall to be commenced.  In addition, there are plans to construct a lane, along the western side of Interstate 75 to provide a direct lane strictly for buses to travel along Interstate 75, which will place Interstate 75 even closer to the “Hawkes Bluff” and “Waverly Hundred” developments;

            WHEREAS, the cost of the sound wall increases dramatically every year, with the current cost being $50.00 per square foot, when just a couple of years ago the cost was $17.00 per square foot, and therefore, it would be more efficient and responsible for Broward County, Florida Department of Transportation, and the United States to allocated the necessary funding and construct the sound wall today, instead of ten years from now.

            WHEREFORE, the undersigned residents hereby petition Broward County, Florida Department of Transportation and the United States of America to allocate the necessary funding to build sound walls along Interstate 75 where said road abuts the IVANHOE DEVELOPMENTS.
